1.1 Seller information

In these Terms, “Miomosa”, “we”, “us” and “our” refer to the company identified above. “Customer” and “you” refer to the person placing an order.

1.2 Scope

These Terms apply to consumer purchases made through www.miomosa.com. By placing an order, you confirm that you have read and accepted these Terms.

Separate written terms may apply to wholesale, salon, distributor and other business-to-business orders. If there is a conflict, the agreed B2B terms will apply to the business transaction.

1.3 Products

We make reasonable efforts to describe and display our products accurately. Because certain Miomosa products are handmade or produced in small batches, minor differences in colour, finish, pattern, fragrance character or appearance may occur. Such natural variations are not normally defects.

Product photographs are illustrative. Colours may appear differently depending on your screen.

The product description, quantity, size, ingredients or composition, instructions and warnings displayed on the relevant product page and label form part of the purchase information. Please read them before ordering and before using the product.

1.4 Product availability

Products are subject to availability. Adding a product to your basket does not reserve it.

If a product becomes unavailable after you place an order, we will contact you and offer:

• delivery at a later agreed date;

• a suitable replacement, which you may accept or refuse; or

• a refund for the unavailable product.

1.5 Placing an order

Before submitting an order, you will be able to review and correct the products, quantities, delivery details and payment information.

An order is submitted when you select the button indicating that the order creates an obligation to pay.

After receiving the order, we will send an electronic acknowledgement. This acknowledgement confirms receipt but does not necessarily constitute acceptance.

The sales contract is concluded when we expressly accept the order or send a dispatch confirmation, whichever occurs first. If payment has already been collected for an order we cannot accept, it will be refunded.

The order confirmation and these Terms will be provided electronically or made available through your customer account in a format that can be stored.

1.6 Refusing or cancelling an order

We may refuse or cancel an order where:

• a product is unavailable;

• payment cannot be authorised;

• delivery information is incomplete or appears incorrect;

• there is an obvious pricing or description error;

• we reasonably suspect fraud, unauthorised resale or misuse;

• applicable law prevents the transaction; or

• the order exceeds an announced quantity limit.

We will inform you and refund amounts collected for products that will not be supplied.

1.7 Prices and VAT

Prices are displayed in the currency selected on the website. Unless clearly stated otherwise, consumer prices include applicable VAT.

Delivery charges and any other mandatory charges will be displayed before you submit the order.

For deliveries outside the European Union, the customer may be responsible for import VAT, customs duties, clearance charges or similar fees imposed by the destination country. These charges are not included unless expressly stated at checkout.

If an obvious pricing error occurs, we may contact you for confirmation at the correct price or cancel and refund the affected item.

1.8 Payment

Available payment methods are displayed at checkout and may vary by destination.

Payments are processed securely by Stripe. The payment provider may apply its own terms and privacy notice. Miomosa does not normally store complete payment-card details.

You confirm that you are authorised to use the selected payment method and that the information supplied is accurate.

1.9 Delivery

We deliver to the destinations listed in our Shipping and Delivery Policy.

Estimated processing and delivery times are not guaranteed unless expressly agreed. We will inform you of material delays.

Risk of loss or damage passes to a consumer when the consumer, or a person designated by the consumer other than the carrier, takes physical possession of the goods.

1.10 Right of withdrawal and returns

Consumers normally have 14 days to withdraw from an online purchase without giving a reason, subject to statutory exceptions.

Instructions, return conditions and the model withdrawal form appear in our Returns, Refunds and Withdrawal Policy.

Nothing in these Terms limits mandatory consumer rights.

1.11 Damaged, incorrect or non-conforming products

Please inspect your delivery promptly. If a product is damaged, incorrect, incomplete or appears defective, contact us at miomosaofficial@gmail.com and provide:

• your order number;

• a description of the problem; and

• photographs where these can reasonably help us assess the issue.

Consumer rights relating to defective or non-conforming products are separate from the 14-day withdrawal right. Where legally required, Miomosa will bear the reasonable costs of returning a defective or incorrect product.

EU consumers benefit from the applicable statutory conformity guarantee. Any additional commercial guarantee offered by Miomosa does not replace or reduce that protection.

1.12 Product use and safety

Products must be used only for their intended purpose and in accordance with the label, instructions and warnings supplied with them.

In particular:

• never leave a burning candle unattended;

• keep flames, hot wax and fragranced products away from children and pets;

• use candles and wax warmers only on stable, heat-resistant surfaces;

• do not apply ordinary candle wax, wax melts, diffuser liquid or home-fragrance products to the skin;

• use the Spa Cream Candle on the skin only if the particular product is expressly labelled for cosmetic use and only according to its instructions; and

• discontinue cosmetic use if irritation occurs.

1.13 Customer accounts

You may be able to purchase as a guest or create an account. You are responsible for:

• providing accurate information;

• maintaining the confidentiality of your login details; and

• notifying us promptly if you suspect unauthorised account access.

We may suspend an account where reasonably necessary to protect customers, prevent misuse or meet legal obligations.

1.14 Promotions and discount codes

Promotions apply only during the stated period and subject to their published conditions.

Unless expressly stated:

• codes cannot be combined;

• codes have no cash value;

• a code may be used once per customer;

• discounts do not apply retrospectively; and

• returned products may cause a discount, reward or free-product condition to be recalculated.

We may cancel a promotion or refuse its benefit in cases of fraud, technical error or misuse, without affecting orders already lawfully accepted unless correction is permitted by law.

1.15 Intellectual property

The Miomosa name, branding, product names, photographs, designs, text, graphics and website content are owned by or licensed to Miomosa.

They may not be copied, reproduced, modified, distributed or used commercially without prior written permission, except where applicable law permits otherwise.

1.16 Personal data

Personal data is handled in accordance with our Privacy Policy. Cookies and similar technologies are addressed in our Cookie Policy.

Acceptance of these Terms does not constitute consent to optional marketing or non-essential cookies.

1.17 Liability

Miomosa does not exclude or limit liability where doing so would be unlawful, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer remedies.

Subject to those rights, Miomosa is not responsible for loss caused by:

• use contrary to the product instructions or warnings;

• unauthorised modification of a product;

• ordinary wear and tear;

• information supplied incorrectly by the customer; or

• events outside our reasonable control.

Nothing in this section reduces mandatory consumer protection.

1.18 Events outside our reasonable control

We are not responsible for delay or failure caused by circumstances we could not reasonably prevent, such as severe weather, transport interruption, fire, epidemic, industrial action, government restrictions or failure of essential networks.

We will take reasonable steps to reduce the effect and will inform affected customers when appropriate.

1.19 Complaints and alternative dispute resolution

Please send complaints to miomosaofficial@gmail.com. Include your name, order number and a description of the issue. We aim to acknowledge complaints within 7 business days and respond within 14 calendar days.

The former European Commission Online Dispute Resolution platform closed on 20 July 2025 and is not used by Miomosa.

1.20 Governing law

These Terms are governed by Romanian law.

If you are a consumer residing elsewhere in the European Union, you also retain any mandatory protection provided by the law of your country of residence. Nothing in these Terms deprives you of the right to bring proceedings before a court that has jurisdiction under applicable consumer law.

1.21 Changes

The Terms applicable to an order are those available when the order is placed. We may update these Terms for future orders by publishing a revised version and effective date.
